<p>Marketing Affiliate Partner Search Policy: Search marketing campaigns cannot use the Lipault trademark or any variation of the Lipault trademark. Marketing Affiliate Partners are NOT ALLOWED to link directly to Lipault from paid search campaigns. Any Marketing Affiliate Partners found bidding on trademark terms or direct linking will immediately be removed from the program and have all commissions reversed. Marketing Affiliate Partners found violating this Search Policy will immediately be removed from the Lipault Marketing Affiliate Partner Program and have all commissions reversed. Marketing Affiliate Partner Coupon Policy: Marketing Affiliate Partners may only promote valid offers available to partners via the Lipault program powered by Impact. Use of coupons/promotional codes not currently available to marketing affiliate partners through Impact will void commission and cash back. Marketing Affiliate Partners must remove coupons/promotions no longer valid and must not use misleading ad copy or messaging expired offers. Marketing Affiliate Partners found violating the Coupon Policy will immediately be removed from the Lipault Marketing Affiliate Partner Program and have all commissions reversed. Marketing Affiliate Partner Unsuitable Web Site Policy: You may not place Links to Lipault Web site or Web site content on Web sites nor may you promote Lipault using methods that Lipault deems, at its sole discretion, unsuitable for its Program, including, but not limited to, Web sites or promotional methods that: 1. promote sexually explicit materials; 2. promote violence, promote discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age; 3. promote illegal activities; 4. are in any way unlawful, harmful, threatening, defamatory, obscene, harassing, or racially, ethnically, or otherwise objectionable; 5. incorporates any materials which infringe or assist others to infringe on any copyright, trademark or other intellectual property rights or to violate the law; 6. any other website that you operate, explicitly or implied in a manner which resembles our website nor design your website in a manner which leads customers to believe you are Lipault.com or any other Marketing Affiliate Partnered business; 7. any promotion via traffic sharing programs, pop-ups or pop-unders; or 8. may damage or tarnish the goodwill of Lipault. Marketing Affiliate Partners found violating the Unsuitable Web Site Policy will immediately be removed from the Lipault Marketing Affiliate Partner Program and have all commissions reversed. Marketing Affiliate partner Unsuitable Action Policy: Marketing Affiliate Partner shall not transmit any so-called “interstitials,” “Parasiteware,” “Parasitic Marketing,” “Shopping Assistance Application,” “Toolbar Installations and/or Add-ons,” “Shopping Wallets” or “deceptive pop-ups and/or popunders” to consumers from the time the consumer clicks on a qualifying link until such time as the consumer has fully exited the Lipault.com site (i.e., no page from our site or any Lipault.com’s content or branding is visible on the end-user’s screen). As used herein “Parasiteware™” and “Parasitic Marketing” shall mean an application that (a) through accidental or direct intent causes the overwriting of Marketing Affiliate Partner and non Marketing Affiliate Partner commission tracking cookies through any other means than a customer initiated click on a qualifying link on a web page or email; (b) intercepts searches to redirect traffic through an installed software, thereby causing, pop ups, commission tracking cookies to be put in place or other commission tracking cookies to be overwritten where a user would under normal circumstances have arrived at the same destination through the results given by the search (search engines being, but not limited to, Google, MSN, Yahoo, Overture, AltaVista, Hotbot and similar search or directory engines); (c) set commission tracking cookies through loading of the Lipault.com site in IFrames, hidden links and automatic pop ups that open Lipault.com’s site; (d) targets text on web sites, other than those web sites 100% owned by the application owner, for the purpose of contextual marketing; (e) removes, replaces or blocks the visibility of Marketing Affiliate Partner banners with any other banners, other than those that are on web sites 100% owned by the owner of the application. Marketing Affiliate Partners found violating any of the above policies will immediately be removed from the Lipault Marketing Affiliate Partner Program and have all commissions reversed. Representation of Nature of Relationship: Marketing Affiliate Partner does not directly sell any contact lens products. If Marketing Affiliate Partner begins directly selling contact lens products, it must immediately notify Lipault. Lipault has engaged Marketing Affiliate Partner solely for the purpose of marketing Lipault’ products.</p>
